Patent Law: History, Theory and Economy

About this course: 

The course considers the historical, theoretical and economic underpinnings of modern patent law. Particular attention is paid to the monopolistic nature of the patent grant and the development of the core of this monopoly: the claims. The course examines key periods within the history of patent law in the UK and elsewhere, and draws on a number of key cases in select jurisdictions that have influenced the modern understanding of the patent grant.

This course is held on Fridays from 4-6pm
Taught by Dr Matt Fisher (UCL)

Topics Covered include

What the patent is and what its economic effects are perceived as being
Including a discussion of monopoly as an economic concept
The early history of the patent
including its origin in Elizabethan England and the abuses of monopoly
Classical economical perspectives on patent law
Including the anti-patent debate
Post- or neo-classical views on patent law as the justification for the
modern patent system
Patent law during the era of globalisation
Including a critique of the global south
The historical development of patent law in the UK
The historical development of patent law in the US
From the constitution to the Court of 26
Appeal for the Federal Circuit and beyond (1790 onwards)
The historical development of claims in Japan and Continental Europe
(particularly Germany)
The development of multi-lateral harmonisation in the patent system
Including through the European Patent Convention and the Patent Co-operation Treaty.
